These Terms & Conditions ("Terms") govern your use of creamwhim.com (the "Site") and any purchases made through it. By accessing the Site or placing an order, you agree to these Terms.

The Site is operated by PT Saint Tropez Bali, trading as Cream Whim, a company incorporated in Indonesia.

1. General

These Terms apply to all visitors, users, and customers of the Site. We reserve the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.

2. Products

We sell clothing and accessories through the Site. We make every effort to display product colours and images accurately; however, actual colours may vary slightly depending on your screen settings. All product descriptions are provided in good faith and we reserve the right to correct any errors.

We reserve the right to limit quantities, discontinue products, or refuse orders at our sole discretion.

3. Ordering

By placing an order, you confirm that:

  • You are at least 18 years of age

  • The information you provide is accurate and complete

  • You are authorised to use the payment method provided

An order confirmation email does not constitute acceptance of your order. Your order is accepted when we dispatch the item(s) and send a shipping confirmation. We reserve the right to cancel any order, in which case you will receive a full refund.

4. Prices & Payment

All prices are displayed in USD (or local currency where applicable) and are inclusive of any applicable taxes unless stated otherwise. We are not responsible for currency conversion fees charged by your bank or payment provider.

We accept payment via PayPal and Xendit (credit/debit card — Visa, Mastercard). Payment is processed securely by our payment providers. We do not store your full card details.

We reserve the right to change prices at any time. Changes will not affect orders already confirmed.

5. Shipping

We ship worldwide. Estimated delivery times and shipping conditions are set out in our Shipping Policy. Delivery timeframes are estimates only and we are not liable for delays caused by customs, couriers, or events outside our control.

Customs duties and import taxes, if applicable in your country, are the responsibility of the buyer.

7. Intellectual Property

All content on the Site — including text, images, logos, designs, and graphics — is the property of PT Saint Tropez Bali / Cream Whim and is protected by copyright and intellectual property law. You may not reproduce, copy, or use any content without our prior written permission.

8. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose

  • Attempt to gain unauthorised access to the Site or its systems

  • Post or transmit any harmful, offensive, or fraudulent content

  • Resell products purchased from us without our prior written consent

9. Limitation of Liability

To the maximum extent permitted by law, PT Saint Tropez Bali / Cream Whim shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or the products purchased. Our total liability shall not exceed the amount paid for the relevant order.

10. Disclaimer of Warranties

The Site and its content are provided "as is". We make no warranties, express or implied, regarding the accuracy, completeness, or availability of the Site. We do not guarantee that the Site will be uninterrupted or error-free.

11. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bali, Indonesia, without prejudice to your rights as a consumer under the laws of your own country.

Syarat & Ketentuan ("Syarat") ini mengatur penggunaan creamwhim.com ("Situs") dan pembelian yang dilakukan melaluinya. Dengan mengakses Situs atau melakukan pemesanan, Anda menyetujui Syarat ini.

1. Umum

Syarat ini berlaku untuk semua pengunjung, pengguna, dan pelanggan Situs. Kami berhak memperbarui Syarat ini kapan saja. Penggunaan Situs yang berkelanjutan setelah perubahan merupakan penerimaan Syarat yang direvisi.

2. Produk

Kami menjual pakaian dan aksesori melalui Situs. Kami berupaya menampilkan warna dan gambar produk secara akurat; namun, warna aktual mungkin sedikit berbeda tergantung pada pengaturan layar Anda. Kami berhak membatasi kuantitas, menghentikan produk, atau menolak pesanan berdasarkan kebijaksanaan kami.

3. Pemesanan

Dengan melakukan pemesanan, Anda menyatakan bahwa:

  • Anda berusia minimal 18 tahun

  • Informasi yang Anda berikan akurat dan lengkap

  • Anda berwenang menggunakan metode pembayaran yang diberikan

Email konfirmasi pesanan bukan merupakan penerimaan pesanan Anda. Pesanan diterima ketika kami mengirimkan barang dan mengirimkan konfirmasi pengiriman.

4. Harga & Pembayaran

Semua harga ditampilkan dalam USD (atau mata uang lokal jika berlaku). Kami menerima pembayaran melalui PayPal dan Xendit (kartu kredit/debit — Visa, Mastercard). Kami tidak menyimpan detail kartu lengkap Anda. Kami berhak mengubah harga kapan saja; perubahan tidak memengaruhi pesanan yang sudah dikonfirmasi.

Bea cukai dan pajak impor, jika berlaku di negara Anda, menjadi tanggung jawab pembeli.

5. Pengiriman

Kami mengirimkan ke seluruh dunia. Lihat Kebijakan Pengiriman kami untuk detail lengkap. Estimasi waktu pengiriman bersifat perkiraan dan kami tidak bertanggung jawab atas keterlambatan yang disebabkan oleh bea cukai, kurir, atau kejadian di luar kendali kami.

7. Kekayaan Intelektual

Semua konten di Situs — termasuk teks, gambar, logo, desain, dan grafik — adalah milik PT Saint Tropez Bali / Cream Whim dan dilindungi oleh hukum hak cipta. Anda tidak boleh mereproduksi atau menggunakan konten apa pun tanpa izin tertulis kami sebelumnya.

8. Perilaku Pengguna

Anda setuju untuk tidak menggunakan Situs untuk tujuan yang melanggar hukum, mencoba mendapatkan akses tidak sah, memposting konten berbahaya atau menipu, atau menjual kembali produk tanpa izin tertulis kami.

9. Batasan Tanggung Jawab

Sejauh yang diizinkan oleh hukum, PT Saint Tropez Bali / Cream Whim tidak bertanggung jawab atas kerugian tidak langsung atau konsekuensial yang timbul dari penggunaan Situs atau produk yang dibeli. Total tanggung jawab kami tidak akan melebihi jumlah yang dibayarkan untuk pesanan terkait.

10. Hukum yang Berlaku

Syarat ini diatur oleh hukum Republik Indonesia. Setiap sengketa akan tunduk pada yurisdiksi eksklusif pengadilan di Bali, Indonesia, tanpa mengurangi hak Anda sebagai konsumen berdasarkan hukum negara Anda sendiri.
